تتناول هذه الدراسة إشكالية "الشرعية السياسية" في الفكر المعاصر من خلال المقارنة بين براديغمين متناقضين: براديغم "القرار السيادي" عند كارل شميت، وبراديغم "السلطة التواصلية" عند يورغن هابرماس. يحلل البحث أطروحة شميت التي تربط السيادة بالقدرة على الحسم في "حالة الاستثناء"، معتبراً القرار أسبق من القانون. في المقابل، تستعرض الدراسة مشروع هابرماس النقدي الذي يسعى لعقلنة السلطة عبر "الفضاء العمومي" والديمقراطية التداولية، محولاً السيادة من إرادة متعالية إلى إجراءات تواصلية بيذاتية. وخلصت الدراسة إلى أن التوتر بين "منطق القرار" و"منطق التداول" يظل بنية جوهرية في الحداثة السياسية، حيث تراهن الديمقراطيات المعاصرة على تقنين القرار دون إلغائه، وتقييد القوة دون شل الفعل السياسي.
