يكتسب النظام العام الاقتصادي، أهمية كبرى في تنظيم مساطر صعوبات المقاولة، باعتباره أداة لحماية وتكريس المصلحة العامة الاقتصادية، الأمر الذي نتج عنه التخلي عن منطق سلطان الإرادة والحرية العقدية لفائدة سلطان القانون، الذي يهدف في صلبه إلى ضمان المصلحة العامة الاقتصادية. الشيء الذي يُضفي على هذا النظام طابعًا يُميزه عن غيره من المنازعات المدنية أو التجارية، مما أبرز الدور المحوري للقضاء التجاري، باعتباره فاعلا تقليديا بأدوار جديدة، يتجاوز فيها نطاق الفصل في النزاعات، ليشكل أداة لتنزيل سياسة تشريعية تستحضر مبدأ استمرارية النشاط الاقتصادي الذي يرتبط بجوهر النظام العام الاقتصادي.
