شركة التضامن هي: عقد بين شخصين أو أكثر، بقصد التجارة، يلتزم كل واحد منهم بالتزامات الشركة، في ماله العام والخاص، ولها ثلاث خصائص: مسؤولية الشركاء الشخصية التضامنية، عدم قابلية حصة الشريك للتداول، توزيع الأرباح وتحمل الخسائر، وتكييفها الفقهي أنها مختلطة بين شركة عنان، وشركة مفاوضة، والراجح: جوازها، إذا لم تتضمن ما يخالف قواعد الشريعة، من شروط أو معاملات محرمة. والله أعلم
