يعد صدور مدونة الأسرة المغربية حدثاً حقوقياً بارزاً سعى من خلاله المشرع إلى تحديث الأسرة وإعادة صياغة العلاقات بين مكوناتها على قيم العدل، والإنصاف، والمساواة، وحفظ كرامة الزوجين والأطفال. وفي هذا السياق، زاوج المشرع في أحكام الوصية الواجبة بالقسم الثامن بين الأصالة الشرعية والمفاهيم الكونية، حاسماً الخلاف الفقهي لصالح القول بمشروعيتها، حيث تجسدت القيمة المضافة للمادة 369 في إلغاء التمييز على أساس الجنس وإلزامية الوصية للأحفاد من كلا الجنسين. ولمعالجة هذه القضية، تأتي هذه الدراسة لتربط بين التأصيل الفقهي والتنزيل القانوني الواقعي للوصية الواجبة، مبرزاً أهميتها البالغة لشريحة مجتمعية واسعة.
