Abstract:

This research article provides a comprehensive analysis of the right to abortion in Morocco, specifically focusing on forced pregnancies and the inherent tension between stringent legal restrictions and individual freedom. The study highlights that Moroccan legislation remains predominantly prohibitive, criminalizing abortion except for very limited therapeutic reasons, primarily when the mother's life is at risk. This legal stance reflects the state’s commitment to protecting prenatal life and maintaining the social moral order. The author examines the legal framework and its limitations when faced with cases of rape, contraceptive failure, or severe social precariousness, analyzing the articulation between domestic law and international reproductive rights standards. Furthermore, the paper sheds light on the extreme vulnerability of women who are forced into clandestine and unsafe abortions, which pose significant health risks. The study argues for a legislative reform that balances traditional values with modern human rights requirements to ensure women's dignity and bodily autonomy. It emphasizes the urgent need for a public health approach that addresses the socio-economic realities of unwanted pregnancies. Ultimately, the research calls for a more inclusive legal dialogue that can provide safe and legal alternatives for victims of forced pregnancies within the Moroccan judicial system.
