Le développement des services de livraison et de transport commandés par application rend visible une difficulté ancienne du droit du travail : distinguer le prestataire indépendant du salarié lorsque la direction se manifeste par un système numérique. Cet article soutient que le Code du travail marocain permet déjà la requalification, à partir de la direction de l’activité et de la preuve par tous moyens. La dépendance économique ne suffit pourtant pas, prise isolément, à établir la subordination. L’expérience française, espagnole et européenne invite à alléger les obstacles probatoires et à garantir certains droits à tout travailleur de plateforme. La solution proposée combine une présomption réfragable de salariat en présence d’indices précis de contrôle avec un socle transversal de protection, sans créer un tiers statut exclusif du droit commun.
