يسلط هذا المقال الضوء على معالم الاجتهاد المقاصدي عند الإمام محمد الطاهر بن عاشور من خلال كتابه المرجعي «مقاصد الشريعة الإسلامية»، مبرزاً ريادته في استخلاص مقاصد الشريعة كعلم مستقل مستنبط من أصول الفقه بعد تنقيته بالنقد والنظر العقلي، وسعيه إلى جعله علماً قطعياً يقوم على وصف الشريعة الأعظم وهو "الفطرة". وتناقش الباحثة أقسام المقاصد ومراتبها (الضرورية، الحاجية، والتحسينية)، وعلاقة هذا الفكر بفقه النوازل وتوسيع دائرة المصلحة في المعاملات دون المساس بالقطعيات والثوابت. كما يستعرض المقال تطبيقات ابن عاشور المقاصدية في قضايا معينة كالنكاح، والمغارسة، ومقاصد العقوبات (تأديب الجاني، وإرضاء المجني عليه، وزجر المقتدين)، وصولاً إلى أحكام القضاء والشهادة؛ ليخلص إلى تقييم منهجه الذي وازن فيه بين التنظير التجديدي في استبدال العلة بالمقصد والمحافظة على الأحكام الفقهية الجامعة في التطبيق العملي.
