لقد اختلف الفقهاء قديما وحديثا في طرق الإثبات في القضاء الإسلامي، فبعضهم حصرها فيما هو منصوص عليه أو مستنبط من الوحي، وبعضهم وسع دائرة الإثبات لتشمل كل ما يظهر به الحق ويسفر به طريق العدلخصوصا وأن الجرائم اليوم أصبحت تتعدد وسائلها وطرقها، كان من فضل الله على الناس لإقامة العدل أن تتطور أدوات التحقيق الجنائي والإثبات في القضاء. ومن أهمها الطب الشرعي الذي أدى تطوره الباهر إلى الكشف عن الكثير من الجرائم
